01.   What is lockout ?

Answer: Lockout is an act of management of any establishment. A lockout is generally intended to put pressure on the workers so that they may agree to the terms of work of the employer.

02.   What is Retirement?

Answer: Retirement means stopping of work after attaining a particular age limit under section 28 of this act.

03.    What is the working hour ?

Answer: Working hour means the time when the worker remains under the control of his employer for work excepting time for eating and resting.

04.    What is Strike?

Answer: Strike means cessation of work by a group of workers employed in any establishment or refusal to work jointly.

05.   What is Retrenchment?

Answer: Retrenchment means termination by the employer of service of a worker on the ground of needlessness caused by redundancy.

06.   What is the Settlement ? 

Answer: Settlement means a settlement arrived at in the course of conciliation proceeding and includes an agreement between an employer and his workmen arrived.

07.   What is Dismissal?

Answer: Dismissal means termination of services of a worker by the employer for misconduct.

08.   What is Wages?

Answer:  Wages means all remunerations expressed in terms of taka or capable of being expressed in terms of taka, which, whether the terms of the contract of employment are expressed or implied, are fulfilled, payable to any worker for his job or work and shall include other additional remuneration of the aforesaid nature.

09.   What is Lay – off?

Answer: Lay – off means the failure, refusal or inability of an employer to give employment to a worker on account of a shortage of coal, power or raw material or the accumulation of stock or break down or going out of order of machinery.

10.   How many kinds of workers?

Answer: There are six kinds of workers.

a.       Apprentices

b.      Badlies

c.       Casual

d.      Temporary

e.      Probationary

f.        Permanent

g.       Seasonal

11.   What is the procedure for leave?

Answer: A worker who desires to obtain leave of absence shall have to apply in writing to his employer.

12.   What is the stoppage of work?

Answer: The employer, at any time, in the event of fire, catastrophe, break down of machinery, stoppage of power-supply, epidemic, civil commotion, or any other reason beyond his control, if necessity demands.

13.   What is the Closure of the Establishment?

Answer: In the event of an illegal strike by any section or department of any establishment, the employer may close down either wholly or partly such section or department and in the event of such closure.

14.   What is discharge?

Answer: Any worker may be discharged from the service on account of physical or mental incapacity or continued ill-health certified from the registered physician.

15.   What is Punishment for Conviction and Misconduct?

Answer:

a.       He is convicted for any criminal offense.

b.      He is found guilty of misconduct under section -24

c.       Termination

d.      Demotion to lower post, grade or pay-scale for not more than one year.

e.      Holding up of promotion for one year.

f.        Fine.

g.       Suspension for not more than one week without wages or without subsistence allowance.

h.      Censure & Warning.

 

16.   Special Provisions relating to fine?

Answer:

a.        During any wage period, no worker shall be fined any amount more than one-tenth of the wages payable to him.

b.      No fine shall be imposed upon a worker who is under the age of fifteen years.

c.       No fine imposed on any worker shall be realized from him by installments or after the expiry of sixty days from the day on which it was imposed.

d.      All fines and realizations thereof shall be recorded in a register prescribed by rules by the employer and all such realized fines shall be spent in the workers beneficial to the workers.

17.   What is Termination?

Answer: Termination of employment by employers otherwise than by dismissal, etc.

a.       The employer otherwise than in the manner provided elsewhere in this chapter can terminate the employment of any permanent worker by giving-

1.       120 day”s notice in writing in the cases of monthly rated workers.

2.       Sixty days’ notice, in writing in the case of another worker.

 

18.   Termination of employment by the workers.

Answer: Any permanent worker may resign from the service by giving the employer 60 day’s notice in writing.

19.   Retirement of the worker.

Answer: Notwithstanding anything provided elsewhere in this chapter, any worker employed in any establishment shall have a normal retirement from the employment on completion of 60 years of age.

20.   Period for the final payment of the worker.

Answer:  The employer shall pay all the dues payable to a worker within 30 working days from the date of cessation of his service due to retirement.

21.   Right and Liability for payment of maternity benefit?

Answer: Every woman worker shall be entitled to get the maternity benefit from the employer for the period of preceding 8 weeks immediately after the date of delivery and her employer shall be bound to pay her such benefit.

Provided that no women worker shall be entitled to such benefit unless she has served under the employer for a minimum period of six weeks immediately preceding the date of delivery.

No women shall be entitled to such benefit if her two or more than two children are alive at the time of her delivery, but in such case, she will get leave if she is entitled to such leave.

22.   Overcrowding.

Answer: No workroom in any establishment shall be overcrowded to such an extent injurious to the health of the workers employed therein. Every worker needs at least 9.5 cubic meter space.

23.   Lighting arrangement. 

Answer: In every part of any establishment where the workers work and passes there shall be an arrangement for sufficient lighting, natural, artificial or both. 

24.   Drinking water.

Answer: There shall be an arrangement for the supply of sufficient pure drinking water in any convenient place of every establishment for all the workers employed therein.

25.   Toilet and washroom.

Answer: The necessary number of shall have to be provided in such a convenient place that the workers employed therein can use them easily during the working hour.

26.   Adopting precaution regarding Fire.

Answer:  In every establishment arrangement shall have to be made for the way to go out at the time of conflagration along with at least one alternative staircase maintaining a connection with each floor and fire extinguisher appliances in the manner prescribed rules.

27.   Floors, stairs, and pathways.

Answer: All floors, stairs, pathways shall have to be soundly constructed and appropriately maintained and where it is necessary for ensuring their safety arrangement for strong railings.

There shall, so far as is reasonably practicable, be provided for safe access to every place at which any person is, at any time, required working.

28.   First aid appliances.

Answer: a. In every establishment, there shall be an arrangement for box equipped with first-aid appliances or almirah equipped with appliances as prescribed by rules during all working hours.

b. The number of such boxes or cupboards shall not be less than one for every one hundred fifty workers ordinarily employed in the establishment.

c. Every first-aid box or cupboard shall be kept in charge of a responsible person who is trained in the first-aid treatment and who shall always be available during the working hours of the establishment.

 

29.  Washing facilities.

 

Answer: In every establishment-

(a) adequate and suitable facilities for washing and bathing shall be provided and maintained

for the use of the workers therein;

(b) separate and adequately screened facilities shall be provided for the use of male and

female workers; and

(c) such facilities shall be conveniently accessible and shall be kept clean.

       30.  Canteens :

 

Answer:  In every establishment wherein more than one hundred workers are ordinarily employed, there shall be provided an adequate number of canteens for the use of the workers.

The Government may make rules providing for-  the standards in respect of construction, accommodation, furniture and other equipment of the canteen; and the constitution of a managing committee for the canteen and representation of the workers in the management of the canteen.

 

    31.Daycare  or Rooms for children :

 

Answer:  In every establishment, wherein forty or more workers are ordinarily employed, thee shall be provided and maintained a suitable room or rooms for the use of children under the age of six years of such women.

 

     32. Group Insurance:

 

Answer: Government may, in the manner provided by rules, introduce group insurance, in the establishments wherein a minimum 100 permanent workers are employed.

 

     33Daily working hours :

 

Answer: No adult worker shall ordinarily be required or allowed to work in an establishment for more than eight hours in any day:

Provided that, subject to the provisions of section 108, any such worker may work in an

establishment not exceeding ten hours in any day.

 

    34. Weekly hours :

 

Answer:  No adult worker shall ordinarily be required or allowed to work in an establishment for more than forty-eight hours in any week.

 

    35. Limitation of hours of work for women :

 

 Answer: No women shall, without her consent, be allowed to work in an establishment between the hours of 10.00PM and 6.00 AM

 

  36. Casual leave :

 

Answer: Every worker shall be entitled to casual leave the full wages for ten days in a calendar year, and such leave shall not be accumulated and carried forward to the succeeding year:

 

37. Sick leave :

 

Answer: Every worker shall be entitled to sick leave with full wages for fourteen days in a calendar year.

 

38. Annual leave with wages :

 

Answer:  Every adult worker of factory who has completed one year of continuous service in an establishment, shall be allowed during the subsequent period of twelve months leave with wages for a number of days calculated at the rate of one day- in the case of a shop or commercial or industrial establishment or factory or road transport service, for every eighteen days of work.

 

 

39. Festival holidays :

 

Answer:  Every worker shall be allowed in a calendar year eleven days of paid festival holiday.

 

 

40. Weekly holiday:

 

Answer: Every worker shall be allowed in one day of the paid weekly holiday.

 

41. Time of payment of wages :

 

Answer: The wages of every worker shall be paid before the expiry of the seventh day after the last day of the wage period in respect of which the wages are payable.

 

42. Participation committee :

 

Answer: The employer in an establishment in which fifty or more workers are normally employed shall constitute in the prescribed manner participation.

Such a committee shall be formed with representatives of all employers and the workers.

The number of representatives of a worker in such a committee shall not be less than the number of representatives of the employer.

 

43. Function s of participation committee :

 

Answer: The functions of the participation committee shall be of inculcating and develop a sense of belonging and workers commitment and, in particular-

(a) To Endeavour to promote mutual trust, understanding, and co-operation between the employer and the workers;

(b) To ensure the application of labor laws;

(c) To foster a sense of discipline and to improve and maintain safety, occupational health and working condition;

(d) To encourage vocational training, workers education and family welfare training;(e) to adopt measures for improvement of welfare services for the workers and their families;

(f) To fulfill the production targets, improve productivity, reduce production cost and wastes and raise the quality of products.

44. Meetings of the participation Committee:

Answer: The participation committee shall meet at least once every two months to discuss and exchange views and recommend measures for the performance of the functions under section 202.

 

45. What is MSDS ?

 

Answer: Material Safety Data Sheet

 

46. How many kinds of fire extinguishers?

 

Answer: There are four kinds of fire extinguishers.

a.       ABC dry powder

b.      CO2 Gas

51. What is a high-rise building?

Answer: High – rise building mean

BNBC Section – 3 Structures or buildings where the highest occupiable floor is located more than 20 m (65 ft) above the grade level around the building.

Accord Section 5.3.3 Automatic sprinkler protection shall be installed throughout all portions of new and existing high--‐rise buildings with an occupiable floor greater than 23 m (75 ft) above the finished grade in accordance with 5.3.3.

52. How many distances one Exit door to another exit door?

Answer:  One door to another door distance 150 fit.

53. How many fire extinguishers needs a floor?

Answer: Every 550 sq fit area need 1(one) ABC dry powder.

Answer: And every DB board need 1 (one) CO2 gas.

Chemical store and generator room need sufficient Foam type.

54. Emergency power:

 

Answer: An emergency power system shall be provided to supply power to the following loads:

1. Exit signs and means of egress illumination

2. Automatic fire detection systems

3. Fire alarm systems

4. Electrically powered fire pumps.

5. Smoke control systems

6. Elevators/lifts

55. Battery-powered signs and exit lights.

 

Answer: Existing battery-operated or uninterruptable power supply systems can be continued to be used to supply exit signs and means of egress illumination where monthly testing of such systems is conducted and properly documented.

 

56. Battery-powered signs and exit lights Duration:

 

Answer: Emergency power shall be provided for a minimum duration of 60 min.

 

57. Fire alarm system.

 

Answer: An automatic fire alarm system shall be provided throughout all new and existing buildings containing an atrium in accordance with Section 5.7.

 

58Aisles:

 

Answer: Minimum aisles shall be maintained free of storage in accordance with NFPA 13 based on the design criteria used for the sprinkler system.

 

59. Exit Passageways:

 

Answer: Exit passageways shall be considered an extension of the stairs and shall not be used for any other purpose.

 

60. What is DB board?

 

Answer: DB board means every floor electrical distribution board.
